  • Mary Jo King Scofield v. Brenda Carr; Circuit Court of Montgomery County, AL; Case # CV-06-1132; Tried August 13, 2007.  This case arose out of a two-vehicle accident which occurred on May 7, 2004.  The defendant made a left turn in front of the plaintiff and failed to yield the right of way.  Negligence was admitted at trial.  The plaintiff initially treated for neck and back pain and was diagnosed with an annular tear.  Approximately 8 months later, the plaintiff fell at home and, after her fall, began complaining of paralysis and loss of sensation in her right leg.  When no physical explanation for the paralysis was found, the plaintiff was diagnosed with hysterical paralysis, and her doctor recommended psychiatric treatment.  The plaintiff’s medical bills up to the time of her fall totaled $22,087.10, and she did not have health insurance.  Before trial, the plaintiff’s last settlement demand was $250,000.  The jury returned a verdict for the plaintiff and awarded damages of $75,000.
