• MOTOR VEHICLE ACCIDENT ( Circuit Court of Houston County): This case arose out of a two-vehicle accident which occurred in Houston County. The defendant, who was driving a Dodge Neon, rear-ended the plaintiff, who was driving a Ford F-250 truck. The accident occurred at night on a dark highway, and the defendant testified that the plaintiff’s tail lights were not working before the accident. The plaintiff claimed that his lights were looking and accused the defendant of failing to maintain a proper lookout. After the accident, the plaintiff received medical treatment for neck pain and headaches and incurred medical bills of $4561.21. Before trial, the defendant offered $10,000 to settle. The jury returned a verdict for the plaintiff and awarded damages of $10,000. Gable v. Whitehead; Case Number 00-35; Tried April 18, 2005.
