Gaines, Wolter & Kinney, P.C. - Trial Results

  • MOTOR VEHICLE ACCIDENT ( Circuit Court of Calhoun County): This suit arose out of a four-vehicle accident which occurred on Highway 78 in Calhoun County. The plaintiff was rear-ended when a vehicle driven by defendant Adair struck a third vehicle driven by defendant Thompson, who was in traffic behind the plaintiff. A fourth vehicle, driven by our client, then struck Adair who again struck Thompson. The driver of the fourth vehicle left the scene. Six days after the accident, the plaintiff sought treatment in the emergency room for neck and back pain. The next day, the plaintiff had the first of forty visits to her chiropractor who, in turn, referred the plaintiff to the attorney who represented her in this action. The plaintiff did not offer her emergency room bills into evidence. She did offer $6,546 in chiropractor bills, all but $1,800 of which was paid by Blue Cross Blue Shield. Before trial, the plaintiff was offered $10,000 to settle. The jury returned a verdict for the defendants. Whatley v. Thompson et al.; Case Number CV-04-1128; Tried May 3, 2006.
